Photo 2 has used natural lighting to frame the bird, the vantage point is from below rather than in front of from a distance further away. Photo 2 doesn't have the same framing with the crop taking in the distracting tree.

Looking up at this angle at the bird allows the sun to highlight the colour of the bird, the beak and feathers on the top of the head are beautifully light and semi-transparent. The clear sky empasises the subject and centring the bird is perfect. The chain and wire balance the photo. Well done. Colin.

I think both of these are poor shots.. it's hard to pick a winner. I guess I chose the first one because of the POV, although again the exposure is bad. The second one is OK but could be better if the camera was even closer to the ground. It's also lacking DOF.
